Acceptance. By using any products or services on this site you automatically
agree to be bound by and to comply by the following terms of service
along with any other term, agreement or rule posted on this site.
Our Terms of Service may and will be changed by us at
ANY
time we see fit.
Legal Age. When using this site it is automatically assumed that you are of
at least 13 (thirteen) years of age or older. If you are not this
age or older, you must have a parent or guardian read this agreement
and give you permission to use the services. A legal parent or
guardian is of at least 18 (eighteen) years or older. This site is
not responsible for any minor who fails to ask permission from a
legal parent or guardian. If any parent or guardian would like their
child's access to this site removed, please contact us at the
address above. The parent/guardian who gave the permission to the
child is responsible for the child's conduct and consequences of the
child's actions.
Registration. Upon registering, you will receive a password and username. You
are responsible for maintaining the confidentiality of the password
and username. You are also fully responsible for all and any of the
activities that occur under your username. You also agree that you
will immediately notify us of any unauthorized use of your account
or any other breach of security, and that you will exit from your
account at the end of each session. We cannot and will not be liable
for any loss or damage that came from your failure to comply with
this section. We also have to refuse your registration based on
lack-of-trust from other trusted sources.
Data Transfer/Content. All data (software, images, e-mails, text) or other materials
transferred from this site to you is the responsiblity of the
person(s) of which this data came from. This also means that you are
responsible for all data that you upload, share, transmit or give
out by the use of this service, and we are not. Since we are not
responsible for this, this also means any content you upload will
never be claimed as ours on our site. We are also not responsible
for any content on websites of which you find via this site, and
cannot be held responsible if you are offended by this content. We
also cannot be held responsible for any damage that occurs from use
of this site OR the services found on this site
OR
content found on third party sites. By agreeing to this you also
state that you will not post, upload, transmit or give out
ANYTHING
that can harm/damage ANYONE/ANYTHING in
ANYWAY
at ANYTIME.
This includes this site by trying to gain access to anything
unauthorized to normal users as well as the property of anyone.
This site does not screen any content being put onto this site,
but if content (or links to content) is found that is not favourable
we do have the right to remove it at anytime we see fit. Content
that is not favourable can include (in form of image, sound, video,
text or anything):

- Spam
- Hate Messages/Racist
Comments/Harassment
- Copyright Infringement
- Impersonation of other people
- Abuse of animals/humans

As mentioned above, all content you post to this site is your
property and will never be claimed by this site.
BUT all
content that is posted to this site may be redistributed with or
without your permission to third parties that we trust. Your content
also may be edited/modified as we see fit for use on the site.
Access Areas. In addition to the publicly accessed areas on this site, there
may be private access areas as well. Any information sent over the
private access system can be read by us and may be read by us if any
non-favourable (see above) activity is found in any other content
you posted to this site. If any illegal content is found you give us
the right to report you to the proper authorities.
Limited Space/Account Deletion. You are given limited space on this site for various services.
For any reason you lose information due to the fact there is not
enough space, it's not our fault it is yours and we can not be held
responsible for this. We can also delete any content we feel is
useless to free disk space to those who have non-useless content.
This also applies to any accounts that are inactive for an extended
period of time. You can request at any time to have your account
removed from this site at the e-mail address above. After your
account is deleted everything you uploaded, transmitted or posted to
this site can still be modified, edited or redistributed by us as we
see fit.
If your account is terminated by us for improper use of this site
(not favourable content) you are not permitted to access this
site/register for this site in the future. If this occurs your
information will be given to the proper authorities and you will be
responsible for any legal fees associated with the incidents.
We also have the right to disable your account if too much
bandwidth/space is being consumed. Services that are free and have
been disabled by us (for you) may now have to be charged for you so
we can support your needs. If you do not wish to pay for the
selected service, we will send you all your important data and then
delete your account. If any important data is lost in this process
we cannot be held responsible.
Your account could be terminated at
ANY time for various
reasons. Anything information lost is not our responsibility as you
placed it on here with the knowledge that it may be lost.
Cookies. While cookies are optional on this site, by agreeing to these
Terms of Service you automatically give us permission to set cookies
whenever we see fit. Cookies are text files stored on your computer
to help us keep track of you on this site, and this site alone. They
may also be used to store preferences or session data.
Copyright. By agreeing to the Terms of Service you also agree that all data
that is written by us, belongs to us and is copyrighted under the
law. You cannot and shall not use any information on this site
without prior permission from us. If any content is found on the web
and the thief/you have not asked for permission, you will be
persecuted to the full extent of the law, and will be responsible
for any legal fees associated with the incident. As well, all
content submitted to this site from third parties is copyrighted to
them and cannot be used without their permission unless otherwise
specified. If we find that third parties' content has been copied
without permission we can and will report this to them.
Security. There is no guarantee that any data on this site cannot be
stolen. Any result from this action will not be the fault of us. Any
incident in which you accept anything from anyone on this site via
the internet or via real life off this site, and damage to yourself,
or any of your property occurs, it is not the fault of us.
Support Restrictions. Cynon
Internet will make every effort to support information for
configuring popular network/web software to use internet services.
However we can in no way specifically test every piece of software
that could conceivably be utilised with our systems, only provide
general system-related information. The offer of any particular
service does not constitute an obligation on Cynon Internet's part
to tutor the necessary skills to utilise that service, only to
provide system-specific information.
Payments. Accounts will be
billed in advance for the month or year of service (some services
are paid annually). If you sign up and receive service today, we
will bill you today for service. No refunds will be processed
without "cause" . You will be notified by e-mail to the address you
signed up with for services of success or failure. If billing fails
and we are unable to process payment for over 72 hours we will
suspend services without further notice. If we are still unable to
collect 7 days past payment due date we reserve the right to
terminate the account and all files on our services without
recourse.
Uptime guarantee. If your
website and/or email becomes unavailable due to reasons at our
facility (or related) and is in excess of 24 hours, We will offer a
refund for 2X the amount of time lost regardless of duration of
downtime for any reason NOT related to customer error up to 100% of
monthly charges refunded for that period.
Cancellation policy. We offer
a 30 day money back guarantee for cause on all hosting, reseller and
dedicated services plans. VPS plans are not subject to this money
back guarantee and are subject to a 15 day money back guarantee and
DO NOT include any refund of licence fees. Cause is any demonstrated
failure on our part to deliver services purchased. If you can
provide us with a reason that we failed to provide the services you
purchased from us we will be more than happy to give you a refund.
Domain registration fee's ARE NOT REFUNDABLE as we register domains
in your name.
Payments. Cynon
Internet accepts all payments via PayPal. We will not accept company
or personal cheques, wire transfers, bank transfers or Postal
orders.
ACCEPTABLE USE POLICY (AUP)
Use of services provided by Cynon
Internet constitutes acceptance and agreement to Cynon Internet's
AUP as well as Cynon Internet's TOS (Terms of Service).
Cynon Internet reserves the right to revise, amend, or modify this
AUP, our TOS (Terms of Service) and our other policies and
agreements at any time and in any manner. Notice of any revision,
amendment, or modification will be posted in accordance with our TOS
(Terms of Service). All users of Cynon Internet services, and their
clients, must comply with this AUP and our TOS (Terms of Service).
Any form of abuse of any nature
(physical, verbal, live chat or email) toward any of Cynon
Internet's staff or outsourced suppliers may result in the
withdrawal of technical support or termination of your accounts with
immediate effect. Termination of accounts is at the discretion of
Cynon Internet and no notice needs to be given. All decisions are
final.
IMPORTANT NOTICE:
We support the uncensored flow of information and ideas over the
Internet and do not actively monitor subscriber activity under
normal circumstances. Similarly, we do not exercise editorial
control over the content of any web site, e-mail transmission,
newsgroups, or other material created or accessible over or through
the services, except for certain proprietary Web sites. However, in
accordance with our TOS (Terms of Service), we may remove any
materials that, in our sole discretion, may be illegal, may subject
us to liability, or which may violate this AUP. Cynon Internet may
cooperate with legal authorities and/or third parties in the
investigation of any suspected or alleged crime or civil wrongdoing.
Your violation of this AUP may result in the suspension or immediate
termination of either your Cynon Internet account or other actions
as detailed below without notice, based upon the nature of the
violation.
Hosting only customers. Please remember, any unlimited E-Mail
Services and/or sub domains are for YOUR use. They are not intended
to be used for re-sale or promotional offerings.
This document is intended to provide a basic understanding of Cynon
Internet's Acceptable Use Policy. The following are guidelines for
the establishment and enforcement of Cynon Internet's AUP. If a
Cynon Internet account violates this Acceptable Use Policy or our
TOS, we reserve the right to terminate your service without notice.
We prefer to advise customers of inappropriate behavior and any
necessary corrective action, however based on the nature of the
violation, could result in immediate termination of service.
The following constitute violations of this AUP:
Illegal activities. Cynon Internet's services may not be used
for illegal purposes, or in support of illegal activities. Cynon
Internet reserves the right to cooperate with legal authorities
and/or injured third parties in the investigation of any suspected
crime or civil wrongdoing.
Harm or Endangerment to other people. You may not use Cynon
Internet's services to harm, or attempt to harm, minors in any way,
including, but not limited to child pornography, or use Cynon
Internet's service to transmit any material (by e-mail, uploading,
posting or otherwise) that threatens or encourages bodily harm or
destruction of property.
Forgery or impersonation. Adding, removing or modifying
identifying network header information in an effort to deceive or
mislead is prohibited. Attempting to impersonate any person by using
forged headers or other identifying information is prohibited. The
use of anonymous remailers or nicknames does not constitute
impersonation.
Unsolicited E-mail, News Bombing (SPAM) Use of the Cynon
Internet service to transmit any unsolicited commercial or
unsolicited bulk e-mail is expressly prohibited. Violations of this
type will result in the immediate suspension of the offending Cynon
Internet account. Spam complaints will be sent to the e-mail address
on file. Failure to respond to complaints within a 24 hour timeframe
will result in the Cynon Internet staff suspending the offending
account by whatever means necessary. Should the account become
re-activated without the express written consent of Cynon Internet,
the offending account will be immediately terminated, and may result
in suspension / termination of the server itself. Anyone hosting
websites or services on their server that support spammers or cause
any of our IP space to be listed in any of the various Spam
Databases will have their server immediately removed from our
network. The server will not be reconnected until such time that you
agree to remove any and all traces of the offending material
immediately upon reconnection and agree to allow us access to the
server to confirm that all material has been completely removed.
Severe violations may result in immediate and permanent removal of
the server from our network without notice to the customer. Any
server guilty of a second violation will be immediately and
permanently removed from our network without notice. Malicious
intent to impede another person's use of electronic mail services or
news will result in the immediate termination of the offending Cynon
Internet account.
Cynon Internet will allow Double opt-in safelists as long as they
are on their own VPS servers. These types of sites use a great deal
of resources and can't be supported through our website or reseller
programs.
Copyright or trademark infringement. Use of the Cynon
Internet service to transmit any material (by e-mail, uploading,
posting or otherwise) that infringes any copyright, trademark,
patent, trade secret or other proprietary rights of any third party,
including, but not limited to, the unauthorised copying of
copyrighted material, the digitisation and distribution of
photographs from magazines, books, or other copyrighted sources, and
the unauthorised transmittal of copyrighted software. Use of the
Cynon Internet service to collect, or attempt to collect, personal
information about third parties without their knowledge or consent.
Distribution and/or posting of copyrighted or the aforementioned
infringements will not be tolerated.
Network disruptions. Use of the Cynon Internet service for
any activity which affects the ability of other people or systems to
use Cynon Internet Services or the Internet. This includes "denial
of service" (DOS) attacks against another network host or individual
user. Interference with or disruption of other network users,
services or equipment is prohibited. Cynon Internet will not
tolerate any subscriber attempting to access the accounts of others,
or penetrate security measures of other systems, whether or not the
intrusion results in corruption or loss of data. Cynon Internet,
does not allow the hosting of IRC, IRC Bots, or eggdrops or
Unauthorized SHELL programs on our network. Accounts found hosting
this material will be subject to immediate cancellation without
refund. Use of the Cynon Internet service to access, or to attempt
to access, the accounts of others, or to penetrate, or attempt to
penetrate, security measures of Cynon Internet or another entity's
computer software or hardware, electronic communications system, or
telecommunications system, whether or not the intrusion results in
the corruption or loss of data, is expressly prohibited and the
offending Cynon Internet account is subject to immediate
termination.
Security. You are responsible for any misuse of your account,
even if the inappropriate activity was committed by a friend, family
member, guest or employee. Therefore, you must take steps to ensure
that others do not gain unauthorised access to your account. In
addition, you may not use your account to breach security of another
account or attempt to gain unauthorised access to another network or
server.
Network security. Cynon Internet accounts operate on
shared network resources. Excessive use or abuse of these resources
by one customer may have a negative impact on all other customers.
Misuse of network resources in a manner which impairs network
performance is prohibited by this policy and may result in
termination of your account.
REPORT VIOLATIONS OF Cynon Internet's AUP. Cynon Internet
requests that anyone who believes that there is a violation of this
AUP direct the information to the Abuse Department at abuse@Cynon
Internet.co.uk if possible, please provide the IP address used to
commit the violation, date and time of the violation, and evidence
of the violation.
Cynon Internet will charge a £25.00 site clean-up fee for any abuse
of the terms listed above.
Exporting Law. Any data transmitted over this site is subject to the law of the
United Kingdom.
Limitation of Warranty.
THE PRODUCTS AND SERVICES ARE PROVIDED "AS IS", WITH NO
WARRANTIES WHATSOEVER. ALL EXPRESS, IMPLIED, AND STATUTORY
WARRANTIES, INCLUDING, WITHOUT LIMITATION, THE WARRANTIES OF
MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND
NON-INFRINGEMENT OF PROPRIETARY RIGHTS, ARE EXPRESSLY DISCLAIMED TO
THE FULLEST EXTENT PERMITTED BY LAW. TO THE FULLEST EXTENT PERMITTED
BY LAW, WE DISCLAIM ANY WARRANTIES FOR THE SECURITY, RELIABILITY,
TIMELINESS, AND PERFORMANCE OF THE PRODUCTS AND SERVICES. TO THE
FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ANY WARRANTIES FOR
OTHER SERVICES OR GOODS RECEIVED THROUGH OR ADVERTISED ON THE
PRODUCTS AND SERVICES OR RECEIVED THROUGH ANY LINKS PROVIDED IN THE
PRODUCTS AND SERVICES, AS WELL AS FOR ANY INFORMATION OR ADVICE
RECEIVED THROUGH THE PRODUCTS AND SERVICES OR THROUGH ANY LINKS
PROVIDED IN THE PRODUCTS AND SERVICES. WE ALSO SIMILARLY DISCLAIM,
TO THE FULLEST EXTENT PERMITTED BY LAW, ANY WARRANTIES FOR ANY
INFORMATION OR ADVICE OBTAINED THROUGH THE PRODUCTS AND SERVICES.
YOU EXPRESSLY UNDERSTAND AND AGREE THAT WE DISCLAIM ANY AND ALL
RESPONSIBILITY OR LIABILITY FOR THE ACCURACY, CONTENT, COMPLETENESS,
LEGALITY, RELIABILITY, OR OPERABILITY OR AVAILABILITY OF INFORMATION
OR MATERIAL IN THE PRODUCTS AND SERVICES. WE ALSO DISCLAIM ANY
RESPONSIBILITY FOR THE DELETION, FAILURE TO STORE, MISDELIVERY, OR
UNTIMELY DELIVERY OF ANY INFORMATION OR MATERIAL. WE DISCLAIM ANY
RESPONSIBILITY OR LIABILITY FOR ANY HARM RESULTING FROM DOWNLOADING
OR ACCESSING ANY INFORMATION OR MATERIAL THROUGH THE PRODUCTS AND
SERVICES, INCLUDING, WITHOUT LIMITATION, FOR HARM CAUSED BY VIRUSES
OR SIMILAR CONTAMINATION OR DESTRUCTIVE FEATURES. WE MAKES NO
WARRANTY REGARDING THE RELIABILITY OR ACCESSIBILITY OF ANY PRODUCTS
AND SERVICES.
YOU UNDERSTAND AND AGREE THAT ANY MATERIAL DOWNLOADED OR
OTHERWISE OBTAINED THROUGH THE USE OF THE PRODUCTS AND SERVICES IS
DONE AT YOUR OWN DISCRETION AND RISK AND THAT YOU WILL BE SOLELY
RESPONSIBLE FOR ANY DAMAGES TO YOUR COMPUTER SYSTEM OR LOSS OF DATA
THAT RESULTS IN THE DOWNLOAD OF SUCH MATERIAL.
Some jurisdictions do not allow the disclaimer of implied
warranties. In such jurisdictions, the disclaimers above may not
apply to you to such an extent as they relate to implied warranties.
Limitation of Liability. YOU EXPRESSLY UNDERSTAND AND AGREE THAT UNDER NO CIRCUMSTANCES
WILL WE LIABLE TO ANY USER ON ACCOUNT OF THAT USER'S USE OR MISUSE
OF THE PRODUCTS AND SERVICES OR RELIANCE ON THE PRODUCTS AND
SERVICES. SUCH LIMITATION OF LIABILITY SHALL APPLY TO PREVENT
RECOVERY OF DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL,
EXEMPLARY, AND PUNITIVE DAMAGES (EVEN IF WE HAVE BEEN ADVISED OF THE
POSSIBILITY OF SUCH DAMAGES). SUCH LIMITATION OF LIABILITY SHALL
APPLY WHETHER THE DAMAGES ARISE FROM USE OR MISUSE OF AND RELIANCE
ON THE PRODUCTS AND SERVICES, FROM INABILITY TO USE THE PRODUCTS AND
SERVICES, OR FROM THE INTERRUPTION, SUSPENSION, OR TERMINATION OF
THE PRODUCTS AND SERVICES AND THE DELETION OF CONTENT (INCLUDING
SUCH DAMAGES INCURRED BY THIRD PARTIES).
SUCH LIMITATION SHALL ALSO APPLY WITH RESPECT TO DAMAGES INCURRED
BY REASON OF OTHER SERVICES OR GOODS RECEIVED THROUGH OR ADVERTISED
ON THE PRODUCTS AND SERVICES OR RECEIVED THROUGH ANY LINKS PROVIDED
IN THE PRODUCTS AND SERVICES, AS WELL AS BY REASON OF ANY
INFORMATION OR ADVICE RECEIVED THROUGH OR ADVERTISED ON THE PRODUCTS
AND SERVICES OR RECEIVED THROUGH ANY LINKS PROVIDED IN THE PRODUCTS
AND SERVICES. SUCH LIMITATION SHALL APPLY, WITHOUT LIMITATION, TO
THE COSTS OF PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES, LOST
PROFITS, OR LOST DATA. SUCH LIMITATION SHALL APPLY WITH RESPECT TO
THE PERFORMANCE OR NON-PERFORMANCE OF THE PRODUCTS AND SERVICES OR
ANY INFORMATION OR MERCHANDISE THAT APPEARS ON, OR IS LINKED OR
RELATED IN ANY WAY TO the PRODUCTS AND SERVICES OR TO US. SUCH
LIMITATION SHALL APPLY NOTWITHSTANDING ANY FAILURE OF ESSENTIAL
PURPOSE OF ANY LIMITED REMEDY. SUCH LIMITATION SHALL APPLY TO THE
FULLEST EXTENT PERMITTED BY LAW.
SUCH LIMITATION OF LIABILITY SHALL ALSO APPLY TO ANY DAMAGE
CAUSED BY LOSS OF ACCESS TO, DELETION OF, FAILURE TO STORE, FAILURE
TO BACK UP, OR ALTERATION OF MEMBER DATA (INCLUDING PASSWORD GATE
PAGES) OR OTHER CONTENT. WITH RESPECT TO PAID MEMBERS (THOSE WHO
CONSUME TOO MUCH BANDWIDTH AND SPACE), OUR ENTIRE LIABILITY, IF ANY,
SHALL NOT EXCEED THE AMOUNT OF THE PAID MEMBER'S MOST RECENT FEE
PAYMENT. UNDER NO CIRCUMSTANCES SHALL WE BE HELD LIABLE FOR ANY
DELAY OR FAILURE IN PERFORMANCE RESULTING DIRECTLY OR INDIRECTLY
FROM ACTS OF NATURE, FORCES, OR CAUSES BEYOND ITS REASONABLE
CONTROL, INCLUDING, WITHOUT LIMITATION, INTERNET FAILURES, COMPUTER
EQUIPMENT FAILURES, TELECOMMUNICATION EQUIPMENT FAILURES, OTHER
EQUIPMENT FAILURES, ELECTRICAL POWER FAILURES, STRIKES, LABOR
DISPUTES, RIOTS, INSURRECTIONS, CIVIL DISTURBANCES, SHORTAGES OF
LABOR OR MATERIALS, FIRES, FLOODS, STORMS, EXPLOSIONS, ACTS OF GOD,
WAR, GOVERNMENTAL ACTIONS, ORDERS OF DOMESTIC OR FOREIGN COURTS OR
TRIBUNALS, NON-PERFORMANCE OF THIRD PARTIES, OR LOSS OF OR
FLUCTUATIONS IN HEAT, LIGHT, OR AIR CONDITIONING.
UNDER NO CIRCUMSTANCES WILL WE BE RESPONSIBLE FOR ANY CHARGES
(INCLUDING NSF CHARGES) YOU INCUR AS A RESULT OF ERRONEOUS CHARGES,
AGAINST YOUR CREDIT CARD OR PAYPAL ACCOUNT, OR AS A RESULT OF YOUR
FAILING TO CANCEL YOUR ACCOUNT AND/OR AUTOMATIC PAYMENTS IN A TIMELY
FASHION.
In some jurisdictions, limitations of liability are not
permitted. In such jurisdictions, the content above may not apply to
you.
We Are Not Responsible. In conclusion, we are not responsible for
ANYTHING that
happens to you, or your belongings at ANYTIME by using this
site. If this occurs, it is your responsibility as
YOU were
the one who accessed the content. In saying so, any content could be
dangerous on this site as there are no screens so
BE CAREFUL.
Any damages to the server caused by will be paid by you in full.
